Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
You agree not to use the Service for any illegal, unauthorized, harmful, or malicious purpose. It is forbidden to upload any images or videos not related to the item you wish to trade and absolutely forbidden to upload offensive, pornographic, or illegal images, texts, etc. You also agree not to interfere with the proper functioning of the Service, to impersonate any person or entity, to harass or harm others, or to create or distribute harmful or illegal content.
In no event shall Luup AS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; (d) unauthorized access, use or alteration of your transmissions or content; and (e) delivery or damages caused by the delivery company, item description, status, and value attributed by users, payment systems provided by Vipps, Stripe, PayPal, etc. Even if a remedy set forth herein is found to have failed of its essential purpose.
You agree that all the information you provide to the Luup platform is accurate, truthful, and current. Any attempt to provide false information, misrepresent the value or condition of items, or any form of fraudulent behavior is strictly prohibited. Luup AS reserves the right to take appropriate action against any violation of this agreement, including, but not limited to, penalizing users by taking away credits or items from the platform, or banning them entirely from the platform without prior notification.
By using the Luup platform, you acknowledge that you are solely responsible for all content you upload or otherwise contribute to the platform.
Luup AS reserves the right, but has no obligation, to monitor disputes between you and other users.
Luup AS has the right to remove any content or suspend any account that is found to be in violation of these terms without any prior notice or liability.
These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
Payment methods, such as Vipps, Stripe, PayPal, etc., may be available for transactions on the Luup platform. The specific payment process, including deductions and timing, will be outlined during the checkout process.
The delivery time for items or services purchased through Luup will vary and be specified by the respective sellers. Sellers are responsible for ensuring prompt and timely delivery of the items to the buyers. The delivery details and estimated timeframe will be communicated to the buyers during the transaction process.
If an item is not as described, users have the option to provide feedback and rating to the "seller," return the item to Luup, or contact feedback@luups.it to resolve the situation.
If a user is unable to deliver the item they have uploaded, it is considered a misuse of the platform. In such cases, the "buyer" has the right to flag the issue and report it to feedback@luups.it for resolution.
Conflict Resolution:Complaints should be initially addressed to the seller within a reasonable time, as stated in points 9 and 10. The parties should attempt to resolve any disputes amicably. If unsuccessful, the buyer may contact Forbrukertilsynet (Consumer Authority) for mediation. Forbrukertilsynet can be reached at +47 23 400 600 or www.forbrukertilsynet.no.
The European Commission's Online Dispute Resolution (ODR) platform can also be used to file a complaint. This is particularly relevant if the consumer is residing in another EU country. The complaint can be submitted here: http://ec.europa.eu/odr.
